Garcia’s PA Transfer

Kilmar Abrego Garcia, a transgender woman convicted of sexual assault in Montgomery County, Maryland, has been transferred to a women’s prison in Pennsylvania, the State Correctional Institution (SCI) Muncy. This decision follows a lawsuit filed by Garcia and the American Civil Liberties Union (ACLU) against Maryland’s Department of Public Safety and Correctional Services, arguing that her placement in male prisons subjected her to discrimination and abuse.

Garcia, who began transitioning in 2015, faced persistent misgendering, verbal harassment, and denial of necessary medical care while incarcerated in Maryland men’s facilities. The lawsuit detailed instances where she was forced to shower with men, faced constant threats, and was generally unsafe.

The ACLU and Garcia argued that Maryland’s prison policy violated the Maryland Constitution by discriminating against her based on her gender identity. They sought to ensure she would be housed in a facility that aligns with her gender identity and receive the necessary medical treatment.

While the Maryland lawsuit is ongoing, the transfer to SCI Muncy in Pennsylvania signifies a potential positive development in Garcia’s case. Pennsylvania’s Department of Corrections policy generally allows for placement decisions based on individual safety and security assessments, taking gender identity into account. The ACLU has stated they are monitoring the situation to ensure Garcia receives appropriate care and treatment in her new facility.
